Terms of Use
The rules for using Specials Nite as a diner, a venue or a paying advertiser.
Last updated:
1. Who we are and these terms
Specials Nite (specialsnite.com and specialsnite.com.au) is operated by Grow Unlimited Pty Ltd, ABN 34 618 591 281, P.O. Box 4134, Hoppers Crossing, Victoria 3029 ("we", "us"). By using the site or app you agree to these terms and to our Privacy Policy. If you use Specials Nite for a business (for example as a venue), you confirm you are authorised to act for that business.
Nothing in these terms excludes, restricts or modifies rights you have under the Australian Consumer Law or other laws that cannot be excluded.
2. What Specials Nite is
Specials Nite is a free directory and map of food and drink specials at restaurants, pubs and cafés. Listings come from venues themselves, from diners, from public sources such as venue websites and open map data, and from our own checks.
Specials, prices, hours and other details are set by the venue and can change without notice. We work to keep them accurate, and listings show whether they have been verified, but we cannot guarantee that a special is still running. Please confirm with the venue before you go if it matters to you. The venue, not Specials Nite, is responsible for honouring its specials.
List order is not a ranking of quality or value. Paid placements are labelled (for example "Priority" or "Sponsored"). Among free listings, claimed venues are shown above unclaimed ones, in the order they claimed.
3. Accounts
- You can browse without an account. To add venues, specials, reviews or photos, or to claim a venue, you need a free account.
- Give accurate details, keep your password private and tell us promptly if you think your account has been misused.
- One person, one account. Accounts may not be sold or transferred.
- We may suspend or close an account that breaks these terms, is used for fraud or abuse, or puts other users at risk. Where reasonable we will tell you why and give you a chance to respond first.
4. Patrons (diners)
Diners ("Patrons") can search, save specials, write reviews, upload photos, suggest edits and submit new venues or specials. Patron submissions are marked unverified until they are checked. Using the site as a Patron is free.
Please do not:
- post fake, paid-for or conflicted reviews (for example about a venue you own, work at or are paid by, or a competitor);
- post content that is unlawful, misleading, defamatory, hateful, sexually explicit, or that infringes someone else's rights;
- post other people's personal information or images of identifiable people without their consent;
- scrape, overload, reverse-engineer or interfere with the site, or try to access accounts or data that are not yours.
5. Content you submit
You keep ownership of reviews, photos and other content you submit. You give us a non-exclusive, royalty-free, worldwide licence to host, display, adapt (for example resize or crop) and share it on Specials Nite and in our promotion of Specials Nite, for as long as it stays on the site and a reasonable time afterwards. You confirm you have the right to grant this licence.
We may moderate, edit for formatting, decline or remove content that breaks these terms or that we reasonably believe is inaccurate. Reviews are never removed or promoted because they are positive or negative. Where a review earned reward points, it is labelled "Earned points for reviewing".
6. Venues and claimed listings
- A free listing may exist for your venue before you claim it, built from public information. You can ask us to correct or remove it at any time.
- To claim a listing you must be the owner or manager of the venue, or authorised by them. We review claims and may ask for proof.
- Claimed venues are responsible for keeping their specials, prices, hours and details accurate and lawful, and for honouring the specials they publish. Specials must comply with the law, including the Australian Consumer Law and liquor laws. Alcohol promotions must not encourage excessive or rapid drinking and must not target people under 18.
- Listing and claiming are free. Optional paid upgrades are described below; you never need them to be listed.
- If a venue is sold, the listing stays with the venue location and the new owner can reclaim it.
Rewards switches on when you claim your listing. You can switch it off at any time in My Venue. While it is on, your staff see limited patron details at the counter (first name, last initial, tier, perks and visits at your venue), and you choose and fund any perks you offer.
7. Paid Priority listings and sponsor banners
- What you get. A Priority listing places your venue at the top of the list for your area with a labelled gold pin. Where several venues pay for Priority in the same area, they are ordered by how long each has continuously held Priority. A sponsor banner shows a labelled banner for the area you choose. Current prices are on the advertise page.
- Prices and payment. Prices are shown in US dollars (any local-currency figure is an estimate). Payment is taken by our payment provider, Stripe, when you check out. We do not store your full card details.
- Term. You pay for a fixed period (for example one or more months). A purchase does not renew automatically unless the checkout clearly says it does. Paying again before or during the grace period below extends your period from its current end date.
- 7-day payment grace. If your renewal payment is received within 7 days after your paid period ends, your continuous "Priority since" date is kept, so a late or retried card payment does not reset your position. After 7 days a new purchase starts a new continuous period.
- Refunds. Paid placement is a service to your business. If we fail to provide it, or the listing is unavailable because of our error for a material part of the period, contact us and we will extend the period or refund the unused portion. Your rights under the Australian Consumer Law are not affected.
- What paid placement does not do. Payment never changes ratings, reviews or verification status, and we do not promise any particular number of views, visits or sales.
8. Founding Venues and the Priority trial
The Founding Venue programme is open to all claimed venues, subject to available founding spots and the eligibility rules below.
Founding Venues
- Who qualifies. A venue that is open for trade, has claimed and been approved, and publishes at least one real, current special within 14 days of approval. One spot per venue location; a group may hold at most one spot per suburb.
- How many. Each suburb has 1 to 5 Founding spots depending on how many venues are in the area. Venues that claimed before the programme opens in their area are included automatically, in claim-date order. If all spots in a suburb are filled, you are placed on a waitlist for your suburb.
- What it means. Founding Venues are shown at the top of the free listings for their suburb, in the order they joined. Paid Priority listings, where any exist, appear above them and are labelled.
- Keeping it. You keep the spot while your listing stays current: the claim stays active, at least one special is confirmed in the last 60 days, and you renew free with one click every 12 months.
- If it lapses. We tell you what to fix and you have 30 days to fix it without losing your place (reminders sent at day 14 and day 25). Once every 12 months you can pause for up to 90 days (for example renovations) by telling us first. If we caused the lapse, we reinstate you.
60-day Priority trial
- Founding Venues can try a Priority listing free for 60 days, once per venue (and once per business group or ABN in any 12 months).
- No card is required and the trial ends automatically. We will never charge you for it. We remind you before it ends.
- If you buy Priority before the trial ends or within 7 days after, your "Priority since" date is backdated to the trial start.
Changes to the programme
We will give at least 60 days' notice before materially changing or ending the programme, and honour accrued Founding rank for at least 12 months if it ends.
9. Diner rewards
The Rewards Program Terms at /rewards-terms set out the complete rules for earning, redeeming and managing rewards points. The Rewards Program Terms apply to all rewards matters and prevail over these Terms of Use where they cover the same topic in more detail.
Key points:
- Members must be 18 or over. One rewards account per person. Rewards is available at Specials Nite venues that offer Rewards, and availability may vary by country and region.
- Points are earned on verified visits to venues with Rewards switched on, based on the food and non-alcoholic drink total entered by venue staff. No points are earned on alcohol, and no rewards involve alcohol.
- Points are pending for 48 hours after a visit so the venue can correct mistakes, then confirm automatically.
- Earning is capped (for example counted spend per visit and earning visits per day). Caps are shown in the Rewards Program Terms.
- Venue perks are funded and fulfilled by the venue offering them. Availability, daily limits and minimum tiers are set by the venue.
- Points have no cash value and cannot be sold, transferred or exchanged for cash. Points expire after 12 months of inactivity; we email a warning 30 days before expiry.
- Friend referrals: You may share your personal referral link with friends. Points are awarded only after your friend has BOTH signed up AND completed their first verified visit. When that happens, you each receive 100 points (pending 48 hours). Points are never tied to buying, paying or subscribing — they are awarded for verified sign-up and a verified visit only, never on sign-up alone. Referral points are capped at 5 successful referrals per calendar month, and are only awarded when both you and your friend have confirmed you are 18 or over. We never send emails or messages to your friend on your behalf; you share your own link. Self-referral is blocked, and possible duplicate accounts are flagged for review. We may suspend referral privileges or reverse points for fraud or abuse.
- We may reverse points earned by fraud, error or collusion and suspend rewards for accounts involved. We give 30 days' notice of programme changes and honour existing balances for at least 90 days after any change that reduces their value.
10. Creator Codes and referrals
- Approved creators may receive a personal code or link. The scheme is single-level only: a creator can earn from people who join with their own code, never from people those people refer.
- A person who joins with a code may receive bonus points on their first verified visits for a limited period, capped. A creator may receive points when someone who used their code completes a first verified visit, and a small, capped share of that person's base visit points for a limited period. Exact amounts and caps are in the Rewards terms.
- Venue first-paid-order bounty: when a venue that signed up with a creator code makes its first paid order for a Priority listing or sponsor banner, the creator receives a one-time bounty. The bounty is paid in rewards points, not cash, and is separate from any commission or discount the venue may receive.
- Joining Specials Nite is free and no purchase is ever required to take part. Creator rewards are points and exposure, not cash.
- Creators must be 18 or over, must clearly disclose that they receive points (using the platform's paid-partnership tools and "#ad" or equivalent), must not make false or misleading claims, and cannot earn anything for reviews.
- We do not send "invite a friend" emails to addresses you type in. Share your own link instead.
- We may withdraw codes and reverse points for self-referral, fake accounts or undisclosed promotion.
11. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with a paid service, you are entitled to cancel and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to compensation for other reasonably foreseeable loss or damage. If a failure does not amount to a major failure, you are entitled to have problems with the service fixed in a reasonable time and, if this is not done, to cancel and obtain a refund for the unused portion.
12. Limits on our liability
To the extent the law allows, Specials Nite is provided "as is", and we are not liable for loss arising from inaccurate venue information, a venue not honouring a special, or content posted by others. Where our liability for a paid service to a business cannot be excluded but can be limited, it is limited to supplying the service again or paying the cost of having it supplied again. Nothing in these terms limits liability for our own fraud, or for personal injury caused by our negligence.
13. Emails we send
We email venues at addresses they publish for business enquiries, and diners who ask to hear from us. Every marketing email identifies us, includes our contact details and a one-click unsubscribe link, and we act on unsubscribes promptly (well within the 5 business days the Spam Act 2003 allows). We will still send essential messages about your account or purchases.
14. Changes and ending
We may update these terms. For changes that materially affect you, we will give reasonable notice (at least 30 days for paid services and programmes) by email or on the site. You can stop using Specials Nite and ask us to delete your account at any time. If we close the service, we will refund any unused paid period.
15. Governing law and contact
These terms are governed by the laws of Victoria, Australia. Questions or complaints:
